What's the difference between an initial consultation and a case evaluation?
These terms are often used interchangeably, but they’re not the same thing. An initial consultation is typically a brief, introductory meeting, and at many firms it’s conducted by a paralegal or intake specialist, not a licensed attorney. A case evaluation is a substantive, attorney-led meeting where a lawyer actually reviews the facts of your case, explains your legal options under Texas law, and gives you honest, direct guidance. How Long Does It Take To Get A Divorce In Texas If Both Parties Agree?
Texas law requires a mandatory 60-day waiting period from the date the divorce petition is filed, even if both spouses are in full agreement. In practice, an uncontested divorce where both parties agree on property, custody, and support typically can easily take between two to six months from filing to final decree, depending on a variety of factors from how quickly parties can get information to court scheduling and the complexity of your situation. When children are involved, the court must also review and approve the parenting plan, which can add time. The more you and your spouse can agree on, the faster and less expensive the process will be.
How Much Does It Cost To Get A Divorce in Texas?
The cost of a Texas divorce varies significantly depending on whether your case is contested or uncontested, whether children are involved, and the complexity of your assets. Attorney’s fees are the largest variable. Jason often says, “Agreements are cheap, easy, and fast. Fighting is not.” In simple terms, an uncontested case with straightforward assets where both parties agree and are motivated to compromise cost considerably less than contested cases involving disputed custody, property division, or business interests, which can run into the tens of thousands of dollars. Texas is a community property state, meaning all marital assets and debts must be properly identified and divided, which adds complexity in high-asset cases. The single most effective way to manage costs is to approach the process strategically rather than emotionally. Conflict is expensive. Agreement is not.
What are temporary orders?
Temporary orders are court orders entered during a case that establish the legal ground rules while the case is pending. Often this happens in the beginning of a case. They answer the immediate, practical questions that can’t wait for a final decree: Who stays in the home? Where do the children live? Who pays the bills? They can cover temporary child custody and visitation schedules, temporary child support and spousal support, responsibility for household expenses, and restrictions on either party from moving, selling assets, or making major financial decisions. Like all things, temporary orders can be agreed upon by both parties. However, if the parties cannot agree, they can be decided by a judge at a temporary orders hearing. Because the arrangements established early in a case often influence the final outcome, especially where children are concerned, this phase of the process deserves serious attention and proper legal representation.
